Unlawful Vehicle Modifications Under traffic laws in most states, drivers may be given a traffic ticket for operating a vehicle that has been modified in violation of laws that regulate vehicle specifications and vehicle equipment. Examples of vehicle modifications that may result in a traffic ticket include:Addition of non-standard lighting (neon "underglow" lights, under-vehicle lights),Alteration or removal of air pollution and emissions control deviceModification of vehicle ground clearance ("lowered" or "raised" vehicles),Removal of mufflers and other sound-control devices, andWindow tinting (especially tinting of windshield or driver/front passenger side windows).An unlawfully-modified vehicle can receive a traffic ticket for a mechanical violation. In some states, citations for certain unlawful vehicle modifications are considered "fix-it" tickets or "correctable violations." In California, for example, if you are given a "fix-it" ticket by a police officer, "yes" will be checked next to "Correctable Violation", and after the problem is fixed (i.e. you remove illegal under-car lights), you must get the signature of an authorized person (i.e. a local law enforcement officer) on the "Certificate of Correction" portion of the ticket. If you are issued a "fix-it" ticket for an unlawful vehicle modification in your state, read the ticket to determine whether you can mail the proof of correction, rather than taking it to court.

If the court accepts your correction, the case will be dismissed. But, if you fail to fix the problem within a short time after you receive a "fix-it" ticket, you will need to pay the fine for the unlawful vehicle modification, and you may be issued another ticket which will go on your record.

Mechanical Violations + Under traffic laws in all states, all motor vehicles are required to have certain equipment properly installed on a vehicle, and that equipment must be functioning correctly while the vehicle is in operation. Window Tint Laws - The Basics Some people believe that vehicle window tinting keeps the temperature inside a car cooler, while others just think window tinting makes a car look cooler. And in some cases, drivers or passengers may have a legally recognizable medical need to have tinted vehicle windows, even when the tint level would otherwise violate their state's vehicle code.

Whatever your reason for wanting tinted windows on your car, truck, or other passenger vehicle, you should get familiar with laws that regulate vehicle window tinting, as well as exemptions under those laws. Window Tinting Basics

What is "window tinting" when it comes to cars, trucks, SUVs, and other passenger vehicles? In practical terms, "window tinting" refers to methods that prevent certain levels of light from passing through the safety glass -- meaning the windshield, side windows, and rear window of a vehicle.

The safety glass on most newer cars and passenger vehicles has been coated or treated so that some degree of window tinting is in place, to keep out harmful ultra-violet (UV) rays. This tinting is done during the manufacturing process, and is almost always in compliance with federal and state window tinting laws and regulations.

But window tinting can also be done after a vehicle has been manufactured and sold (or "after-market," in the vernacular). And it is when these modifications are made -- often by a private "customizing" company or by the vehicle's owner him/herself -- that window tint laws are most often violated.

Window Tint Laws

Vehicle window tinting is almost always regulated under state law, and the applicable statutes can usually be found in a state's vehicle or traffic code. The applicable vehicle code section in your state may discuss vehicle window tinting as "Material Obstructing or Reducing Driver's View" (in California), "Windshields and windows obscured by non-transparent materials" (in Massachusetts), or "Sun-shading or tinting films or applications" (in Virginia).

Your state's vehicle code may consider "window tinting" to include:Heat-shrinking a tinted sheet of film to a vehicle's windshield or window, usually on the inside surface of the glass. This is usually done "after-market.""Shade bands," usually meaning a thin, horizontal strip of tint at the top of a vehicle's windshield, where it meets the vehicle roof.Sunscreen devices that are temporarily affixed to the inside surface of a vehicle's windshield, side windows, or rear window (i.e. a plastic shade device on a passenger side window, held in place with suction cups).

Most state laws on vehicle window tinting are concerned mainly with the levels of "light transmittance" or "luminous reflectance" that the vehicle's safety glass allows -- meaning how much light can get through and how much visibility the glass allows. So, if the windows on a vehicle are tinted to such a degree that the amount of light that can come through is below the amount identified under state law (i.e. 75% light transmittance), then the vehicle does not comply with the state's vehicle code, and the vehicle's owner will be issued a citation. Many state vehicle codes contain different light transmittance requirements for the vehicle's front windshield, when compared with standards for the vehicle's side and rear windows.

Finally, most state vehicle codes specify that no vehicle windshield or window may contain opaque or mirrored material, or "one-way" glass.

Does Your Vehicle's Window Tinting Violate Your State's Laws?

Measurements like "light transmittance" and "luminous reflectance" can be difficult to understand, let alone calculate with any level of confidence. So you may want to have your vehicle inspected to determine whether it is in compliance with your state's window tint laws. Neon car lights, also referred to as "underglow" lights, are non-standard neon or LED lights that attach to the under body of a car, truck, or motorcycle. Neon underglow lights are especially popular among aftermarket car dealers and owners seeking to enhance the look of a car, among other things. Some people believe that neon underglow lights provide a good-looking safety feature, especially among motorcycle riders who drive at night, by helping them worry less about getting hit by other vehicles. Most people who use neon underglow lights, however, cite the "cool factor", and believe that underglow lights help create a halo effect making the car appear as though it is floating.

Laws concerning the use of neon underglow lights are typically covered under the lighting requirements ofstate traffic laws or motor vehicle codes. Most states have specific laws concerning restrictions on the use of accent lighting and otherunlawful vehicle modifications, in terms of color, form, type, and location on the vehicle. As a general principle, underglow lights are legal so long as they remain covered and unlit on public roads and do not flash or include the colors red or blue.

Neon Underglow Lighting Laws -- The Basics

Neon underglow lighting laws are called by many names. Some of the legal titles that cover the use of neon underglow lights and other lighting modifications may fall under any of the following titles:After-Market Lighting;Vehicle Equipment Regulations;Ground-Effect Lighting;Lighting Equipment, or simply "Equipment";Lighting Reflectors; andVehicle Accessory Specifications.

Neon underglow lighting laws exist to help keep the highways safe, and drivers free from distractions that may lead to hazardous driving conditions or situations that disturb the peace. For safety or other emergency reasons, the laws generally restrict the color and type of neon accent lights a driver may add to a car. While yellow and amber neon lights are generally accepted in most places, red and blue lights are often restricted because of its common use on police cars.

Similarly, lights that flash or blink are also restricted based on their common association with ambulances and other emergency safety vehicles. Therefore, these limits are placed on car modifications to prevent other drivers on the road from getting confused or distracted.

Specific State Law Examples

Some states like California, Kansas, and Arizona, allow the use of neon underglow car lights with restrictions on a particular color and location. For instance,Arizona traffic laws only allow amber or white lights (without glare) on the side portions of a car.Kansas traffic laws allow the use of neon ground lighting on vehicles, except for flashing or red lights, or where the tube is visible.

Other states, like Michigan, do not allow the use of any color of flashing, oscillating, or rotating lights on the body of a car being driven on public highways that is not expressly required or permitted under theMichigan traffic laws, except for emergency and other vehicles.

Penalties for Neon Underglow Lights Violations

A neon underglow lighting law violation is considered a civil infraction, punishable as a non-moving traffic violation. Non-moving traffic violations are heard by a district judge or magistrate in a district court close to where the infraction occurred.

Under traffic laws in most states, drivers may be given a ticket for modifying a car in violation of the state's traffic and vehicle modifications laws. In most cases, this will be in the form of a "fix-it" ticket. A driver would have the opportunity to correct or remove the violation by a showing to a police officer or motor vehicle department that the issue was fixed.

Otherwise, a driver who has received a civil infraction ticket may typically respond by any of the following ways:Admit responsibility and pay the fine indicated;Admit responsibility with an explanation and pay the fine indicated;Deny responsibility and ask for an informal court hearing to explain to a judge the circumstances (without attorney representation);Deny responsibility and ask for a formal hearing where a prosecutor will have to show the person violated a law or ordinance (with an attorney to represent you).
